Introduction: in modern conditions of rapidly developing economic crisis associated with the instability of the ruble against foreign currencies, significant price increases, inflationary pressures, etc., the problem of consumer debts caused by consumer credits becomes a macroeconomic problem and threatens the stability of the banking system of the Russian Federation. The goal is to address the importance for the development of Russian civil law tasks, – the disclosure of the methodological foundations of comparative studies of the Institute of insolvency (bankruptcy) of a citizen under the laws of Russia and the United States. Results: the doctrinal productivity will contribute not only to the legislative fullness in the settlement of relations arising from the recognition of a citizen insolvent (bankrupt) and to the solution of a serious dificulty application of laws plan. Methods: the study used the following methods: General scientific dialectical, universal scientific methods (analysis and synthesis, induction and deduction, comparison, abstraction, formal logical, systemic-structural), specifically legal methods (comparative legal, systematic interpretation method, method of legal modeling). Conclusions: the author concludes that applying the concept of “insolvency”, the Russian legislator negate the theoretical discussion will address legal and technical defect, expressed in the presence of the double terminology, abandon legislative “plagiarism”, which should recognize the term “bankruptcy”, as well as strengthen the age-old historical traditions of the Russian legislation.

В специальной цивилистической литературе термин «методология» принято использовать в двух основных значениях. Во-первых, под методологией принято понимать систему методов, эпистемологических принципов и основополагающих теоретических представлений, оказывающих фундаментальное влияние на выбор исследователем соответствующего подхода, видение им изучаемого предмета, конкретные способы его постижения.
